The Juvenile Justice (Care and Protection of Children) Act, 2015 is an Act of the Parliament of India to consolidate and amend the law relating to children accused or convicted of committing offences, and to provide for their care, protection and rehabilitation.

The Juvenile Justice (Care and Protection of Children) Act, 2015 was introduced in the Lok Sabha by the Minister of Women and Child Development, Maneka Gandhi, on 22 December 2014. The Bill replaces the Juvenile Justice (Care and Protection of Children) Act, 2000.

The Act defines a child as a person who has not completed eighteen years of age. Under the Act, a child in conflict with the law is a child accused of an offence. A child in need of care and protection is a child who is found in a situation where the child’s physical, mental or emotional needs are not being met and where there is a risk of the child being harmed.

The Act provides for the setting up of Child Welfare Committees (CWCs) and Juvenile Justice Boards (JJBs) in each district. The CWCs are to be headed by a magistrate, and are to consist of two social workers and a representative of the Childline India Foundation.

The CWCs are to be responsible for the care and protection of children in need of care and protection, and for the supervision of children in conflict with the law.

The JJBs are to be headed by a chairperson who is a magistrate, and are to consist of two social workers. The JJBs are to be responsible for the adjudication of children in conflict with the law.

The Act provides for the establishment of Special Juvenile Police Units (SJPUs) in each district. The SJPUs are to be headed by an officer of the rank of Inspector, and are to consist of a woman police officer, one probation officer, and one representative of the Childline India Foundation. The SJPUs are to be responsible for the rescue of children in need of care and protection, and for the investigation and case management of children in conflict with the law.

The Act provides for the setting up of special homes for the care and protection of children in need of care and protection, and for the rehabilitation of children in conflict with the law.

The Act also provides for the setting up of Observation Homes, Fit Facilities Homes, and Special Homes.

The Act provides for the appointment of Child Protection Officers in each district. The Child Protection Officers are to be responsible for the registration of cases of children in need of care and protection, and for the investigation of cases of children in conflict with the law.

The Act provides for the setting up of Juvenile Justice Boards in each district. The Juvenile Justice Boards are to be responsible for the adjudication of cases of children in conflict with the law.
