Code of Civil Procedure

Code of Civil Procedure, 1908 is the principal set of rules governing the procedure of the civil courts in India. It was enacted by the Indian Legislature in 1908 and came into force on 1st July, 1909. It extends to the whole of India except the State of Jammu and Kashmir.

The Code of Civil Procedure is divided into two parts.
Part I contains general provisions which are applicable to all civil proceedings.
Part II contains special provisions which are applicable only to certain proceedings.

Part I of the Code contains six chapters.
Chapter I contains general provisions related to the commencement and institution of suits.
Chapter II contains provisions related to the place of suits.
Chapter III contains provisions related to the service of summons and other processes.
Chapter IV contains provisions related to the appearance of parties.
Chapter V contains provisions related to the pleadings of the parties.
Chapter VI contains provisions related to the trial of suits.

Part II of the Code contains three chapters.
Chapter VII contains special provisions related to the trial of suits in the High Court.
Chapter VIII contains special provisions related to the trial of suits in the Small Causes Court.
Chapter IX contains special provisions related to the execution of decrees and orders.

The Code of Civil Procedure contains many important provisions which are beneficial to the litigants. Some of these are as follows:

1. The Code lays down the procedure to be followed by the civil courts in India.
2. The Code provides for the commencement and institution of suits.
3. The Code provides for the service of summons and other processes.
4. The Code provides for the appearance of parties.
5. The Code provides for the pleadings of the parties.
6. The Code provides for the trial of suits.
7. The Code provides for the execution of decrees and orders.
8. The Code contains many important definitions.
9. The Code contains many important rules of procedure.
