The decision came in response to a <strong>Presidential Reference<\/strong> under Article 143 of the Constitution, where 14 key questions were referred to a five\u2011judge Constitution Bench headed by Chief Justice <strong>B.\u202fR. Gavai<\/strong>. <\/p>\n\n\n\n<p>The Court examined <strong>Articles 200 and 201<\/strong> of the Indian Constitution \u2014 which prescribe how state Governors and the President deal with bills \u2014 and held that <strong>rigid judicial timelines<\/strong> for granting assent are <em>not permissible<\/em>. <\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_the_Court_Held_Key_Legal_Principles\"><\/span>What the Court Held: Key Legal Principles<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Constitutional_Discretion_Must_Be_Preserved\"><\/span>Constitutional Discretion Must Be Preserved<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Bench unanimously ruled that the Constitution <strong>does not mandate a fixed period<\/strong> within which a Governor or the President must decide on a bill\u2019s assent.  Imposing strict deadlines would amount to <strong>judicially rewriting<\/strong> the Constitution \u2014 something the Court held to be beyond its power. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"%E2%80%9CAs_Soon_As_Possible%E2%80%9D_%E2%89%A0_a_Fixed_Deadline\"><\/span>\u201cAs Soon As Possible\u201d \u2260 a Fixed Deadline<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>While <em>Article 200<\/em> uses the phrase \u201cas soon as possible,\u201d the Court clarified that this does <strong>not mean a specific number of days<\/strong>. The wording imposes <strong>an obligation of expedition<\/strong>, but it cannot be translated into a universal \u201c30 days\u201d or \u201c90 days\u201d rule. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"No_%E2%80%9CDeemed_Assent%E2%80%9D_via_Judiciary\"><\/span>No \u201cDeemed Assent\u201d via Judiciary<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Court rejected the idea of \u201cdeemed assent\u201d granted by courts under their plenary powers (such as via Article\u202f142). Doing so would amount to <strong>judicial usurpation<\/strong> of the Governor\u2019s or President\u2019s constitutional role.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"But_Indefinite_Delay_Is_Not_Allowed\"><\/span>But Indefinite Delay Is Not Allowed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Although strict timelines are disallowed, the Court made it clear that <strong>prolonged, unexplained, and indefinite inaction<\/strong> by a Governor or President is open to <strong>limited judicial review<\/strong>.  Courts may intervene by issuing a mandamus directing them to act \u201cwithin a reasonable time,\u201d but <strong>without questioning the merits<\/strong> of their decision. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Dialogue_Over_Confrontation\"><\/span>Dialogue Over Confrontation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Court emphasized that the Governor\u2019s power to return a bill with comments (or reserve it for the President) is part of a <strong>constitutional dialogue<\/strong>, not a confrontation.  In the spirit of <strong>cooperative federalism<\/strong>, Governors should actively engage with the legislature rather than obstructing bills.<\/p>\n\n\n\n<hr class=\"wp-block-separator
